POLICY OWNERS

This policy is jointly owned by the Vice President for Research and the Vice President for University Operations.

PURPOSE OF THIS POLICY

The U.S. Government prohibits government employees, contractor personnel or their agents from engaging in any form of trafficking in persons. As a federal contractor, this policy signals Colorado State University’s commitment to comply with applicable federal laws, regulations, and policies.

APPLICATIONS OF THIS POLICY

This policy applies to all sponsored projects conducted at Colorado State University and all employees, agents, affiliates, and subcontractors who participate in performing tasks related to such activities, including those individuals working in University-owned or controlled facilities, as well as when working on behalf of the University in non-University facilities.

DEFINITIONS USED IN THIS POLICY

Trafficking in Persons: The U.S. Government defines trafficking in persons as, “The recruitment, harboring, transportation, provision, or obtaining of persons through the use of force, fraud, or coercion, for the purpose of subjection to involuntary servitude, peonage, debt bondage, or slavery. It also includes sex trafficking, and inducing a commercial sex act by force, fraud, or coercion, or in which the person induced to perform a commercial sex act is under 18 years old.” Additional definitions and relevant terms can be found in the U.S. Government’s implementation of 48 CFR § 52.222-50.

POLICY STATEMENT

Trafficking in persons is a violation of U.S. Law and recognized as a violation of human rights. Colorado State University prohibits trafficking in persons, as defined by 48 CFR 52.222-50, for forced labor and any related activities that directly contribute to trafficking in persons.

POLICY PROVISIONS 

Pursuant to Part (h) of 48 CFR § 52.222-50 Colorado State University will maintain a Compliance Plan when contracting for supplies, other than commercially available off-the-shelf items, acquired outside the U.S., or services performed outside the U.S. with an estimated value that exceeds $550,000. The Compliance Plan will be appropriate for the size and complexity of the contracted work and size and scope of the activities and contain no less than the minimum elements required in Part h(3).

COMPLIANCE WITH THIS POLICY

Non-compliance with this policy would be a violation of Colorado and U.S. Law as well as Colorado State University’s Principles of Community. Colorado State University will take action for violation of this policy including, but not limited to, removal from the federal award, and taking disciplinary action up to and including termination of employment.

PROCEDURES, FORMS AND TOOLS

When proposing the use of federal funds to purchase supplies or services outside of the U.S. and subject to 48 C.F.R. § 52.222-50: 

A. The project Principal Investigator shall develop a Compliance Plan in consultation with the Office of Sponsored Programs and the Office of the General Counsel, and: 

  1.  Distribute the Compliance Plan pursuant to 48 C.F.R. 52.222-50(h). 
  2. Notify the Office of Sponsored Programs immediately of any information, from any source, that alleges that an employee, agent, affiliate, or subcontractor has engaged in conduct that violates any part of this policy. 

B. All University employees, agents, affiliates, and subcontractors engaged in the federal contract shall notify the Office of Sponsored Programs immediately of any information, from any source, that alleges conduct that violates any part of this policy. 

C. University employees are expected to report any credible information regarding human trafficking incidents to the CSU System Compliance Reporting Hotline.
